The job becomes vacant at the end of the year when Craig Gargotta, the current U.S. bankruptcy judge for the Western District of Texas at Austin, will assume the bench of Leif Clark, who is retiring as U.S. bankruptcy judge of the Western District’s San Antonio Division, says Kyle Boudreau, 5th Circuit assistant circuit executive.
Candidates must file their applications by Aug. 31. Edith Jones, chief judge of the 5th Circuit, will appoint a merit selection panel made up of a circuit judge, district judge and a lawyer representative, explains Boudreau.
“They conduct all the interviews. They will then provide a report to the 5th Circuit Judicial Council ranking the top five candidates,” he says. The council will narrow the field to three candidates, and the 5th Circuit will choose among them for the new U.S. bankruptcy judge for Austin — a 14-year appointment.
