Mr. Tottenham tries to put it off on the Supreme Court, but the State Bar proposed the form of the ballot, and the Supreme Court, in its order, wrote, "The Court’s approval of this referendum is not a predetermination of any legal issues regarding the proposed rules."

If the State Bar had complied with the statute instead of playing games, the rule against having sex with clients (the one proposal on which, I hunch, most Texas lawyers would agree) might have passed.
