Austin 3rd Court of Appeals Justice Bob Pemberton says he has applied to the Office of the Governor for appointment to the Texas Supreme Court seat vacated earlier this month when Scott Brister left the high court to join Andrews Kurth as a partner in Austin. Pemberton, whom Gov. Rick Perry originally appointed to the 3rd Court in 2003, says he filed an application for the appointment shortly after Brister announced in August that he would step down. Pemberton has won election to the 3rd Court twice since his appointment. Prior joining the 3rd Court, Pemberton was senior counsel at Akin Gump Strauss Hauer & Feld in Austin. And before Pemberton was at Akin Gump, he served as deputy general counsel to Perry, according to the Dec. 2, 2003, news release from the Office of the Governor that announced Pemberton’s appointment to the 3rd Court. Pemberton says he has not ruled out the possibility that he will run for the Supreme Court if he is not appointed to Brister’s seat. “For now, I’ve simply applied for the appointment,” he says.
